1. Who we are and what these terms cover

The website flowit.ro (including its associated campaign pages, the “Website”) is operated by Flow Information Technology S.R.L. (“Flow”, “we”, “us”), with its registered office in Bucharest, Sector 2, Str. Italiană no. 21, postal code 020974, registered with the Trade Register under no. J40/24935/2022, VAT no. RO47360774.

These terms and conditions (the “Terms”) govern access to and use of the Website. By using the Website, you agree to these Terms. If you do not agree, please do not use the Website.

The Terms cover the use of the Website only. The IT services Flow provides to its clients are governed by separately concluded contracts and offers, which prevail over these Terms in all matters concerning the contractual service relationship.

 

2. Informational nature of the content

The content of the Website (service descriptions, packages, specifications, articles) is provided for information and presentation purposes. We make reasonable efforts to keep the information accurate and up to date, but we do not guarantee that it is complete or error-free at all times.

The prices, discounts and packages displayed on the Website are indicative and do not constitute a binding offer. A binding offer, with the final configuration, price and conditions, is provided in writing following your request and an assessment of your needs. Promotional offers displayed are valid for the period indicated on the respective page and may be modified or withdrawn.

We reserve the right to change the content of the Website, the services presented and the indicative prices at any time, without prior notice.

 

3. Use of the Website

You undertake to use the Website in accordance with the law and these Terms. In particular, it is prohibited:

• to attempt to gain unauthorised access to the Website, to the server hosting it or to systems connected to it;
• to interfere with the operation of the Website (including through denial-of-service attacks, code injection or unauthorised vulnerability scanning);
• to submit unlawful content, malware or unsolicited bulk messages through the Website’s forms;

• to use the Website in any way that could harm Flow or third parties.

We reserve the right to restrict access to the Website, without notice, in the event of a breach of these Terms or of security risks.

By submitting a form on the Website, you agree to be contacted by Flow in connection with your request. Submitting a form does not create any contractual obligation for either party — a contractual relationship arises only through the acceptance of a binding offer or the signing of a contract.

Please provide accurate and complete information in the forms. The processing of personal data submitted through the forms is described in our Privacy Policy.

 

5. Intellectual property

The content of the Website — texts, graphics, logos, structure, code — is the property of Flow or its licensors and is protected by copyright and intellectual property legislation. Viewing and downloading the content is permitted solely for your own informational use. Any reproduction, distribution or commercial use of the content without our written consent is prohibited.

Third-party trademarks, trade names and logos displayed on the Website (for example, those of technology partners or of clients who have given their consent) belong to their respective owners and are displayed for identification purposes only.

• temporary interruptions, errors or unavailability of the Website, including those caused by maintenance, third-party providers or events beyond our reasonable control.

Nothing in these Terms excludes or limits Flow’s liability in situations where the law does not permit such exclusion or limitation (for example, for intent or gross negligence), and nothing affects the rights consumers have under applicable legislation.

 

8. Data protection and cookies

The processing of personal data in connection with the use of the Website is described in our Privacy Policy, which forms part of the framework for using the Website. Cookies are used in accordance with the choices you express through the consent banner.

 

9. Governing law and dispute resolution

These Terms are governed by Romanian law. Any dispute relating to the use of the Website shall first be addressed amicably; we encourage you to contact us at contact@flowit.ro. If an amicable resolution is not possible, the dispute shall be settled by the competent courts of Romania.

If you use the Website as a consumer, you have the right to use alternative dispute resolution mechanisms: the Romanian National Authority for Consumer Protection (ANPC — anpc.ro, including the SAL platform) and the European Online Dispute Resolution platform (ec.europa.eu/consumers/odr).

 

10. Final provisions

If any provision of these Terms is declared void or unenforceable, the remaining provisions shall remain in force, and the affected provision shall be interpreted so as to reflect its original intent as closely as possible, within the limits of the law.

Flow’s failure to exercise any right under these Terms does not constitute a waiver of that right.

We may amend these Terms at any time; the current version, with the date of the last update, is permanently published on this page. Significant changes will be signalled through a visible notice on the Website. Continued use of the Website after the amendments take effect constitutes acceptance of them.
